Seth Berman Comments on FTC Probe Into Equifax Data Breach in E-Commerce Times

Seth Berman, a partner in Nutter’s Litigation Department and leader of the firm’s Privacy and Data Security practice group, analyzed the U.S. Federal Trade Commission opening an investigation into the data breach at Equifax in E-Commerce Times. In the article, “FTC Confirms Probe Into Equifax Data Breach,” Seth said, “Equifax faces potential legal liability on a couple of fronts.” He added that the FTC has broad authority to investigate data breaches, particularly given the fact that Equifax is a credit reporting agency that deals with consumer finances, and also since Equifax has been caught up in past investigations by the agency.
