Eric Magnuson, co-chair of Nutter’s Business Litigation practice group, discussed a U.S. District Court ruling on how an Alabama university’s enrollment of a Massachusetts student in an online degree program did not create Massachusetts jurisdiction over the student’s lawsuit against the school in Massachusetts Lawyers Weekly. In the article, “No Massachusetts Jurisdiction over Online University,” Eric pointed out that the decision underscores that to establish personal jurisdiction over a school offering an online distance learning program, a plaintiff must show that the school purposefully availed itself of conducting activity in the forum state.
