Mary Ryan, member of the firm’s Land Use Land Use, Permitting and Development practice group, published “SJC issues important decisions affecting MEPA appeals” in the Spring 2010 issue of REBA News. The article discusses the recent decision in Town of Canton v. Commissioner of the Massachusetts Highway Department et al., which provides important clarification of the critical question of the statute of limitations for appeals under the Massachusetts Environmental Policy Act, G.L.c. 30, §§ 61-62H (MEPA), but unfortunately does not remove all the uncertainty facing practitioners.
