Nutter attorneys achieve significant victory in eminent domain trial

BOSTON, MA — Nutter achieved a significant victory on November 18 in Barnstable Superior Court for the firm’s client, Sorenti Brothers, Inc., in an eminent domain case for the taking of property for the development of the “flyover” at the Sagamore Bridge. The jury returned a verdict for the full amount of $5.3 million that the client was seeking. The dispute focused on the Commonwealth’s eminent domain takings of land near the former Sagamore Bridge rotary and the “just compensation” owed to the client as a result of the Commonwealth’s exercise of eminent domain. The trial team was led by litigation partners Nelson G. Apjohn and Robyn S. Maguire, and supported by associate Alison C. Casey.
