Sarah Kelly quoted in “DiMasi jury reexamines its instructions”
Print PDFSarah Kelly, a member of the Government Investigations and White Collar Defense practice group, was quoted in “DiMasi jury reexamines its instructions” in The Boston Globe on June 15. The article discusses the fact that the jury deliberating in the public corruption trial of former House Speaker Salvatore F. DiMasi asked Judge Wolf to repeat his instructions on honest services fraud. “This is the heart of the case, and the jury wants to make sure they have the law exactly right on the critical issue of honest services fraud,’’ said Sarah.
This is the first high-profile full honest services case to go to trial since the Skilling ruling. Sarah noted that Judge Wolf’s instructions to jurors seem to have addressed the spirit of the Supreme Court’s decision despite the fact that appellate courts have not yet addressed legal questions resulting from the ruling. “That’s what Judge Wolf told the jury, that they have to find an actual quid pro quo, an exchange of money or other good for the action,’’ she said.
