Matt Snell Discusses Potential Changes to PFAS Waste Cleanup Rules in Bloomberg Law

Matt Snell, a partner in Nutter’s Real Estate Department and co-chair of both the Environmental and Energy and Development, Land Use, and Zoning practice groups, discusses the scope of PFAS wastes covered under the Resource Conservation and Recovery Act (RCRA) in Bloomberg Law. The article, “State Power Over PFAS Waste Cleanups Unclear as US Weighs Rules,” examines the possibility of states and the EPA being able to order cleanups of PFAS and other hazardous chemicals even if the compounds don’t meet the RCRA’s definition of wastes. Noting that state RCRA orders to federal agencies to clean up PFAS, which aren’t specifically listed as solid or hazardous waste under law’s implementing regulations, could be challenged, Matt said that this scenario would likely require a court to decide.
