Kathy Williams, Ph.D., a partner in Nutter’s Intellectual Property Department and chair of the firm’s Life Sciences group, discussed how Merck has sued Johns Hopkins in a patent dispute in BioCentury. In the article, “Merck, Johns Hopkins dispute Keytruda patents,” Kathy said, “While patent laws permit a patent on a new use of a drug, the issues here are not only whether Merck should have been joint inventors with Johns Hopkins University on this so-called new use, but also the fact that Merck had an option to license patents based on the joint research collaboration.”
