Nutter Secures Defense Verdict After Six-Day State Court Jury Trial in New Orleans Civil District Court

David Ferrera and Ritika Bhakhri — partnering with long-time colleagues Richard Sarver, Shaun McFall, Kyle Siegel, and Aaron Steeg at Barrasso Usdin Kupperman Freeman & Sarver, and David Schmahmann in Boston — secured a defense verdict for Johnson & Johnson company DePuy Synthes after a six-day state court jury trial in New Orleans Civil District Court. The product liability victory was the first lawsuit involving DePuy’s orthopaedic bone cement used in joint replacement surgery to go to trial, and soundly rejected plaintiff’s arguments under the Louisiana Products Liability Act that the product was defective and unreasonably dangerous.
