David Ferrera, a partner in Nutter’s Litigation Department and chair of the firm’s Product Liability practice group, and Mike Leard, an associate in Nutter’s Litigation Department, co-authored an article that analyzed the resurgence of the tort theory of innovator liability in the IADC’s Drug, Device and Biotechnology Committee Newsletter. In the article, “Innovator Liability: A Recent Resurgence,” David and Mike discussed the tort theory, which is when a brand-name drug manufacturer may be held liable for injuries allegedly caused by the use of a generic drug, and what the future may hold.
