Ben Stern, a partner in Nutter’s Intellectual Property Litigation practice group, analyzed how the Supreme Court did not address the broader questions of copyrightability of computer software in Google LLC v. Oracle America Inc. in Law360. In the article, “How High Court May Tackle Fair Use In Warhol Case,” Ben discussed that it remains to be seen whether the Supreme Court will extend its application of the fair use doctrine to works of art in another case now pending before it, the Andy Warhol Foundation for the Visual Arts Inc. v. Goldsmith case.
