Overview

Mariel T. Smith is an associate in Nutter’s Litigation Department. Mariel practices in a broad range of litigation, including complex commercial litigation, commercial real estate, land use and zoning, construction litigation, and probate and family litigation. She has experience across multiple stages of civil litigation, including dispositive motion practice, taking and defending depositions, participating in mediations and arbitrations, and second chairing bench trials. Mariel prides herself on the attention and care she provides to her clients on cases of all sizes. 

Notable Experience and Client Impact

  • Represented a real estate developer in connection with a permit and zoning challenge to an affordable housing development.
  • Represented a private equity firm in litigation related to unrecovered monies lent to a real estate developer.
  • Represented an individual in bringing a petition for removal of trustees in probate court.
  • Represents former tenants in litigation to enforce contract for development of affordable housing in Boston-area.
  • Represents Boston landlord on a variety of tenancy issues and concerns.

Mariel also maintains an active pro bono practice, including work on immigration and affordable housing cases.

Prior to joining Nutter, Mariel served as a legal intern at the Committee for Public Counsel Services (CPCS) in the Child and Family Law Appellate Division in Boston. She researched and wrote policy-based memoranda distributed to the CPCS child and family law attorneys. In addition, she conducted moot courts and reviewed briefs to aid attorneys in preparing for oral advocacy. Mariel also worked as a legal assistant at a law firm in Greater Boston, where she researched issues including estate planning, real estate, and mental health proxy matters, and aided in trial preparation.
