Litigation publishes “Reinventing Witness Preparation” by Kenneth Berman
Print PDFKenneth R. Berman, co-chair of the firm’s Business Litigation practice group, published “Reinventing Witness Preparation” in the Summer 2015 issue of the American Bar Association’s Litigation journal.
The article discusses how standard witness preparation techniques carry more downside risk than is realized and often are ill-suited for modern litigation. By offering new approaches to preparing witnesses for interrogation by opposing counsel, Ken shows how witnesses can offer better, more credible, and less impeachable testimony, testifying with more care and confidence, with real insight and facility, and drawing upon skills already familiar to witnesses from ordinary conversation. He points out that the historic core of conventional witness preparation—the idea that less is more—is not always a helpful guidepost and that in many instances, more is more.
