Overview
Daniel W. Hartman is an of counsel in Nutter’s Corporate Department and a member of the firm’s Banking and Financial Services group, where he focuses on representing banks, bank holding companies, credit unions, and other financial institutions in regulatory, transactional, supervisory, and enforcement matters. Dan relies on his experience as counsel at the Federal Reserve Bank of Boston where he advised on matters involving bank mergers and bank and holding company activities, formal and informal supervisory enforcement actions and appeals, discount window access and emergency lending programs, and Federal Reserve master account requests. While at the Fed, Dan also represented the Reserve Bank in multiple investigations and audits, including before Congress, various inspectors general including the Special Inspector General for Pandemic Recovery (SIGPR), the Securities and Exchange Commission (SEC), and the Department of Justice (DOJ), in addition to internal investigations.
Dan handled a wide range of regulatory matters while at the Fed working closely with colleagues at the Board of Governors and other reserve banks across the Federal Reserve System. These matters included advising on establishing and implementing the Bank Term Funding Program (BTFP) to ensure banks had the ability to meet all of their depositors’ needs following the 2023 failure of Silicon Valley Bank; advising on implementation and operations, as well as enforcement actions in connection with the Main Street Lending Program (MSLP), established to support small and medium-sized businesses in response to the COVID-19 pandemic; advising on appeals of the Fed’s material supervisory determinations; and providing counsel on merger applications and supervisory matters concerning the Federal Reserve Act, Bank Holding Company Act (BHC Act), Home Owners’ Loan Act (HOLA), Dodd-Frank Act, and other banking and consumer protection laws.
In addition to bank regulatory issues, Dan also has extensive experience in counseling on legal and policy issues related to consumer protection, anti-money laundering, and novel fintech activities and partnerships. Prior to his public service at the Boston Fed, Dan represented financial institutions before the Federal Reserve, Office of the Comptroller of the Currency (OCC), the Federal Deposit Insurance Corporation (FDIC), the Securities and Exchange Commission (SEC), the Consumer Financial Protection Bureau (CFPB), the Federal Trade Commission (FTC), the Department of Justice (DOJ), the Internal Revenue Service (IRS), Congress, and the Massachusetts attorney general, among other states.
Notable Experience and Client Impact
Regulatory Counseling and Transactions
- Counseled a coalition of commercial finance Fintech companies on federal and state regulatory and legislative issues related to marketplace lending and small business lending.
- Advised a national mortgage lender on reforms to TILA and RESPA policies and procedures following compliance review.
- Advised a consumer lending company on FCRA compliance relating to furnishing consumer information and using consumer reports.
- Advised a national trust company and asset management firm on the OCC approval process for merger transactions and primary office relocations.
Supervision and Enforcement
- Represented Massachusetts community banks and credit unions defending against class actions on overdraft fees
- Represented mortgage lender in Massachusetts Attorney General investigation into lending practices
- Represented a Massachusetts bank in U.S. House of Representatives committee investigation
- Represented a major credit card issuer in a CFPB and DOJ investigation and related state litigation regarding the Equal Credit Opportunity Act (ECOA) and state-level fair lending issues.
- Represented a large national bank in CFPB and OCC investigations into potentially unauthorized bank account openings and other sales practices.
- Represented a national mortgage servicer in CFPB investigation into the loss mitigation application process and RESPA and UDAAP compliance.
- Represented a national student loan servicer in multiple regulatory inquiries into federal repayment programs.
- Represented a national debt collector in FTC investigation into FDCPA compliance in student loan collections.
Dan maintains an active pro bono practice, where he focuses on civil rights issues relating to the First Amendment, including representation of a New Hampshire veterans’ organization defending against a First Amendment challenge to a display honoring prisoners of war at the Manchester VA hospital. Additionally, Dan served a four-year term as a member of the Massachusetts Advisory Committee to the U.S. Commission on Civil Rights.
Dan rejoined Nutter in 2025. Earlier in his career, he was an associate in the Financial Institutions Group of the Washington, DC office of an international law firm. Dan is a member of the American Bar Association Banking Law Committee and the Financial Services & E-Commerce Practice Group of the Federalist Society.
During law school, Dan served on the editorial board of the Cornell Journal of Law & Public Policy. He also interned at the U.S. Department of the Treasury’s Office of Financial Stability.

From 2020 to 2024, Dan handled a wide range of regulatory matters at the Federal Reserve, including helping establish and implement the Bank Term Funding Program (BTFP) in the wake of 2023 liquidity concerns arising after the failure of Silicon Valley Bank; advising on implementation, operations, and enforcement actions in connection with the Main Street Lending Program, an $18 billion program operated by the Boston Fed that supported small and medium-sized businesses across the country that were in sound financial condition prior to the COVID-19 pandemic; and providing counsel on applications and supervisory matters of bank holding companies and state member banks in New England.

Dan maintains an active pro bono practice, where he focuses on civil rights issues relating the First Amendment, including as counsel for amicus in multiple U.S. Supreme Court cases, and representation of a New Hampshire veterans’ organization in federal district court defending against a First Amendment challenge to a memorial display honoring prisoners of war and soldiers missing in action at the VA hospital in Manchester, NH. Additionally, Dan served a four-year term as a member of the Massachusetts Advisory Committee to the U.S. Commission on Civil Rights.
